CR109 is RVD's Notice of New Letting or Renewal Agreement. For a domestic tenancy under Part IV of the Landlord and Tenant (Consolidation) Ordinance, the landlord must submit it within one month of making or renewing the agreement. Late submission currently costs HK$310. Regulated tenancies use AR2 instead.

Distinguish CR109, AR2 and stamping

These are separate processes. Stamping does not mean CR109 has been filed or endorsed. Do not use the regulated-tenancy form for an ordinary domestic letting.

Deadline, fee and endorsement
Count the one-month period from making or renewing the agreement, not an assumed move-in date. Timely endorsement is free; late submission costs HK$310. Recheck the current form before filing.
The form notes say the landlord cannot maintain an action to recover rent under the agreement without the Commissioner's endorsement. Keep submission evidence and the endorsed copy separately; submission confirmation is not proof of endorsement or a guaranteed court result.

- Confirm the premises, extent of the letting and tenancy category.
- Use the signed agreement to check its date, term, rent and charge arrangements.
- Prepare landlord, tenant and correspondence details; confirm authority if an agent files.
- Follow the current official fields rather than copying another tenancy's details.
- Send sensitive details only to the official service or authorised recipients, not public examples, groups or search queries.

Submission and record keeping
- Open CR109 / e-CR109 from RVD's forms page and verify the official destination.
- Complete and review the dates, rent and parties against the signed agreement.
- Submit electronically or by post / personal service as instructed; fax is not accepted.
- Retain the submitted version, transaction reference or delivery evidence, and any fee-payment evidence.
- Keep the endorsed copy with the agreement; ask RVD about incorrect details or an unclear status.

Example: agreement before move-in
Suppose the agreement is made on 3 October and occupation starts on 1 November. Check the 3 October agreement date when preparing CR109 rather than waiting for occupation. Keep the agreement and stamp certificate, CR109 submission evidence and subsequent endorsed copy as separate records.

Is CR109 still needed after stamping?
Stamping and notifying RVD are separate. Check the tenancy category: use CR109 rules for Part IV domestic tenancies and the separate AR2 rules for regulated tenancies.
Does late filing invalidate the agreement?
Do not equate late filing with an invalid agreement. Official notes specify a late fee and restrictions on rent-recovery proceedings without endorsement; validity and individual disputes need separate assessment.
